Welcome to Tipster, operated by App-Magic LLC (“App-Magic,” “we,” “our,” or “us”).
These Terms & Conditions (“Terms”) govern your access to and use of the Tipster mobile application, website, and related services (collectively, the “Service”).
By creating an account or using Tipster, you agree to these Terms. If you do not agree, you may not use the Service.
1. Eligibility
You must be at least 13 years old to use Tipster.
By using the Service, you represent and warrant that:
- You are legally able to enter into these Terms.
- All information you provide is accurate.
- You will comply with applicable laws and regulations.
App-Magic LLC may suspend or terminate accounts that violate these Terms.
2. Description of Service
Tipster is a platform that allows users to create profiles, receive digital tips, and interact through payment-related features.
Tipster is not a bank, financial institution, money transmitter, or investment platform. We reserve the right to modify, suspend, or discontinue parts of the Service at any time.
3. User Accounts
To use certain features, users may be required to create an account.
Your Responsibilities:
- Maintaining account security and protecting login credentials.
- All activities occurring under your account.
You Agree Not To:
- Impersonate another person or use false information.
- Access accounts without authorization.
- Use the Service for unlawful purposes.
4. SMS Terms & Conditions
By providing your mobile phone number and using APP MAGIC LLC services, you agree to receive SMS messages related to account authentication, verification, login security, and other important service-related communications.
SMS messages may include:
- One-time password (OTP) verification codes
- Login verification messages
- Security notifications and account alerts
Message frequency may vary. Message and data rates may apply according to your mobile carrier plan. You may opt out of SMS communications at any time by replying STOP.
5. Payments & Digital Tips
Tipster enables users to send and receive digital tips.
By using payment features, you acknowledge that:
- Transactions may be processed by third-party payment providers who may require identity verification.
- Processing fees may apply.
- Transactions may be delayed, reversed, or declined.
App-Magic LLC does not guarantee uninterrupted payment processing. Users are solely responsible for complying with tax obligations related to received funds.
6. Prohibited Activities
Users may not use Tipster to:
- Violate laws or regulations or commit fraud.
- Launder money.
- Harass or abuse others or distribute harmful content.
- Interfere with platform security or use automated bots.
We reserve the right to investigate and remove violating accounts or content.
7. User Content
Users may upload profile information, usernames, photos, and other content.
You retain ownership of your content, but by uploading it to Tipster, you grant App-Magic LLC a non-exclusive, worldwide license to host, display, and operate the Service. You are responsible for ensuring your content does not violate laws or third-party rights.
8. QR Codes & Public Profiles
Tipster may provide QR codes linked to user profiles.
Information displayed through public profiles or QR codes may be visible to others. Users are responsible for the information they choose to share publicly.
9. Intellectual Property
All Tipster software, branding, logos, graphics, and platform content are owned by App-Magic LLC or its licensors.
You may not copy platform materials, reverse engineer the Service, or use Tipster branding without permission.
10. Third-Party Services
Tipster may integrate with third-party services, including payment providers and analytics services. App-Magic LLC is not responsible for third-party services, websites, or policies.
11. Account Suspension & Termination
We may suspend, restrict, or terminate accounts if these Terms are violated, fraudulent activity is suspected, or if required by law. We reserve the right to refuse service at our discretion.
12. Disclaimer of Warranties
Tipster is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, App-Magic LLC disclaims all warranties, including Merchantability, Fitness for a particular purpose, Non-infringement, Continuous availability, and Error-free operation.
13. Limitation of Liability
To the fullest extent permitted by law, App-Magic LLC shall not be liable for indirect damages, lost profits, data loss, financial losses, unauthorized account access, or payment provider failures.
Our total liability shall not exceed the amount paid by you to use the Service, if any.
14. Indemnification
You agree to defend and indemnify App-Magic LLC from claims, damages, liabilities, and expenses arising from your use of Tipster, your violation of these Terms, or your violation of laws or third-party rights.
15. Privacy Policy
Your use of Tipster is also governed by our Privacy Policy. Please review it to understand how we collect and use information.
16. Changes to Terms
We may update these Terms from time to time. Continued use of Tipster after changes means you accept the updated Terms.
17. Governing Law
These Terms shall be governed by and interpreted under the laws of the United States, without regard to conflict of law principles.
